Terms and conditions

This is a translation for your convenience; the German version is the legally binding one.

1. Provider and scope

The provider is Alexander Baruschke, Bramfelder Dorfplatz 4a, 22179 Hamburg, Germany. These terms apply to every contract on the paid versions of the test.

2. What is being supplied

The subject matter is a guided set of questions and an evaluation calculated from your answers, supplied as digital content. The evaluation rests on weightings we have set. It is not a measurement, not a diagnosis and not a scientifically validated procedure. No particular result is owed.

3. Conclusion of the contract

You choose one of the tests. Immediately before you order, the page shows the main characteristics of the service, the total price including VAT and the duration. The button is labelled “order with an obligation to pay”. Clicking it is your offer. The contract is concluded when we confirm it by email; under section 312f of the German Civil Code you receive that confirmation on a durable medium. The contract text is stored and sent to you with the confirmation.

4. Prices and payment

The prices shown on the page apply. All prices include statutory VAT. Payment runs through Stripe, where direct debit, card and further payment methods are available. The service is released immediately after payment. On request, a bank transfer is also possible. Payment in advance then applies: the service is released once the money has arrived.

We send the bank details by e-mail on request. Please use the order number from the confirmation e-mail as the payment reference.

Each test is paid for once and supplied once. There is no term, no subscription and no renewal. There is therefore nothing to cancel: the cancellation button required by section 312k(2) of the German Civil Code applies only to paid continuing obligations.

5. Right of withdrawal

The information on the right of withdrawal applies.

6. Rights of use

You receive a simple, unlimited right to use your evaluation privately. You may save it, print it and show it to individuals. Commercial distribution, resale and publication of entire evaluations are not permitted. The fragrance database, the questions and the weightings remain with us; they are a database within the meaning of sections 87a et seq. of the German Copyright Act.

7. Liability

We are liable without limitation for intent and gross negligence and for damage arising from injury to life, body or health. Where we slightly negligently breach a duty that makes proper performance of the contract possible in the first place and on which you may rely, liability is limited to the foreseeable damage typical for this kind of contract. Liability is otherwise excluded. Liability under the German Product Liability Act remains unaffected.

The evaluation is a recommendation, not a warranty of any quality. Whether a fragrance pleases you on your own skin is for you to decide; that is what the step of testing it on your skin is for.

8. Final provisions

German law applies. Consumer rights under mandatory provisions of the country where the consumer is resident remain unaffected.
